Some thoughts about marriage in America

The US District Court Judge Vaughn Walker has held that Proposition 8 which outlawed same-sex  marriage was unconstitutional and that this  is because heterosexual couples and same-sex couples were identical.  The judge ruled that the ban on homosexual unions was simply a kind of persecution which is at once entirely unmerited and simply cruel. There will be a lot of controversy as this goes through appeals and makes its way to the Supreme Court. But it does raise issues related to marriage and particularly polygamy that I wish to discuss here. I am going to point out a couple of my own posts where I have touched on issues relating to marriage, sexuality and the varied crises and have in one of them at least touched upon polygamy. However, the issues covered in this post do not require a close reading of these posts.

I start with this post above because I think that it is vital that we recognize how far away from any ideal of marriage that has been proposed by the Christian faith in it its most idealistic and monogamous we really are.  If polygamy could be achieved for a portion of the many who are having children and expressing their sexuality with no reference to that ideal then it would be progress in terms of social and cultural nearness to both the spirit of Christ and the life of the gospel. That does not mean that there are not real risks and nothing that can be lost which is valuable and precious.

That is especially true for those of us who have the kinds of ideals that relate to humanism, Christianity and Judaism. It is imperative that we become conversant with reality again.

I am a Christian and Christianity has never been the most polygamous religion. However, it has never been as completely anti-polygamous as it currently has almost entirely become. The Roman Catholic theologian Tertullian argued against the common and theologically supported practice  of priests (some of whom were celibate even then) commonly marrying two wives and especially sisters. When Tertullian was later disciplined for other reasons it is possible that in part it was because of the portion of the church which believed polygamy was an important part of the Christian tradition for some men in leadership both royals and some clerics especially. But there were few Christian royals (not none) in the third century. This is just part of the picture: Charlemagne who was able to add the filioque procedit   phrase to the Western version of the creed was an open polygamist as were all of his sons. 

One issue that I think has to be discussed if one is going to discuss polygamy at all reasonably is that one has to begin to visualize it in order to understand it and discuss. Where it has been so universally illegal for so long it is not so easy to visualize. I want to include some film and television references that deal with varied and complex glimpses of polygamy and make it possible to see where the institutions of plural marriage have found their way into American viewerships and audiences.  Here are some worth watching:

The  fourth link is to a fictional family trying to restore and modernize Mormon polygamy. It is complex, muddied by multiple perspectives at times but I think it is a good show nonetheless.

Then I want to show some examples of contracted relationships between Americans in our history and present.  These are real lives past and present that matter to those who live them quite a bit. As a committed son of Louisiana I am pleased to discuss one of the institutions that expressed polygamy in a new and workable way tied to old traditions. Take a chance to look at this and I may return to it later and have actually touched upon this before in other posts. Clearly the social realities of the quadroon ball are very far from where we are now. But if you take a global perspective it is entirely clear to me that  they were often superior values and ideals from which we could still benefit some day.

I also wonder how it would feel to be this young woman in the next video and be aware of all that is disastrous in our sexual realities in the world and still have one’s lifestyle just barely outside the criminal. I think it is horribly tragic.

It is to be remembered that if you are reading this blog you are reading the blog of someone who wants to change and reform the government and not either escape or limit it into insignificance. I think that governments of the States of the Union and of not yet existing institutions I have proposed would have a vital role to play in making any polygamous domestic institutions work.  It is not entirely clear to me whether the current king of Thailand can be said to ever really have entered into plural marriage. I have not confidential sources and the public sources that I have seen indicate all sorts of contradictory things. It is perhaps a powerful sign of anti-polygamy in the United States that the only true Oriental King to have been born to the rights of an American citizen is part of the possible complete dismantling of an institution so valued in Thailand. However, it may be that it has been a slightly concealed part of his life. One thing to understand that is really vital is that those of us who would rather not lie, murder slaughter innocents wholesale or proceed blindly into the future have competitors and opponents who would  like to have all these thing happen routinely and others who would like most of them to happen often. We can still recognize that polygamy is something less than the best and highest forms of monogamy and acknowledge it has a role to play in the survival of anything that can be called civilization.

I will make on of my personal revelations here in this post. I have been married only once and to only one person. Although I am involved with Christian ministry I am not a regular churchworker and not reaping rewards that would cause me to greatly limit my romantic life on that basis alone. Given the actual realities of my life I think it is true that I have had a very limited sex life outside of the seven years of my marriage. However, I have dated a lot. I have sometimes had more than one girlfriend who knew each other. In a few of those instances I have dated two women who were lesbians and attached to each other. I would not flatter my self so much as to say that had polygamy been legal I might have married those gals, certified one as a covenant mistress and one as her maid or whatever else. But it has been an issue in my actual life. I am getting old and tired and mean and in every way less eager to marry but I feel personally that  I have been harmed as well as in the lives of my friends.  

There is so much more to discuss. Polygamy has dark potentials and sides that must be resisted and that is why government has a role to play. I am not interested in persecuting homosexuals but I do think commitments between wives or ladies and maids in royal harems meets the needs of those who really need commitment and maintains marriage between a man and a woman.  I do not want a world where all monks and canons are presumed homosexual. But I do believe homosexuals who care for each other can find civilized happiness as part of such groups. We must find ways to embrace sane civilized options that are imperfect and build again. We live in a world where ruin and deliberate evil  combine to threaten more than most people can imagine. Life will not be improved by further simplifying a too simple society nor by pretending same-sex couples are capable of marriage to each other as heterosexual couples are  capable of contracting such unions.

Awareness of Pain: A Post With Many Links

I think that most people who read this blog with any sense of fairness will recognize that I advocate much more sweeping and radical constitutional change in the United States than almost anyone with prominent access to prominent media advocates. It is a basic truism (and almost a basic truth) that in order to justify advocating  radical change a responsible person must have already found or must promptly find very serious problems and dangers that justify undertaking the risks inherent in making large changes. It is also fair to assume that regular readers will notice that in fact I have often pointed out very serious problems in this country. This post is about the awareness of those problems and dangers which beset our country. 

There is a film which by using Homer’s Odyssey set in the south of this country shows a bit of the gritty reality of our near past. It is part of a method of a awareness to watch such films and in that film there is song. The song does not  reflect the situation in the film. It seems a pleasant and fun place doesn’t it? Yet we also live in beautiful world and being aware of it and what endangers it is also a sacred trust. Let’s get back to that song set in a film reworking Homer’s Odyssey with slightly different lyrics longer and a bit more on our point but similar.

If the soldiers were all made of lead one cannot help but wonder if it would be less important to fight just wars nobly and to seek peace. If ice cream fell like snow and lakes were full of stew then perhaps our agriculture and employment policy would matter less.  But for now we must be aware of how living things, people and communities do find their sustenance. Now, we can return to  song which stands in for many other points of view. I recall, but have not checked, that in the film Brother Where Art Thou? they used the version of the song where the word “frogs” is replaced with “cops”. I think the cops version is the original there would be less food in a world where frog legs were toothpicks and that does not go with the song. On the other hand for someone who wants a free lunch the world would be more abundant if there were only cops with wooden legs and bulldogs with rubber teeth keeping him from other people’s property.

The song is fun. Living in a world where policy is made on the basis of the idea the song represents but reality is what it is  would not  be fun for a whole lot of people. In many ways that is the world we live in today. Old Testament prophets decrying impiety and humanity, Romantic poets decrying the loss of understanding of nature, Revolutionaries decrying the loss of national integrity or sanity — these are  all examples of a nation’s pain response and awareness. Life is made less frivolous and harder because of the pain we feel when we want to lose ourselves in the moment or the life time of doing whatever it is we would rather be doing. Documentarians have played an important role in recent decades and over much of the last century in pointing out what is wrong  with the world — a useful thing to know.

The first shows a part of the truth of how America becoming play obsessed and focused only on market discipline can play out in a complex world. There is a lot more that is only hinted at such as the destruction of some of the local Mardi Gras and Carnival traditions by visitors who only come for debauchery without the limits of traditions. There is also the fact that things may be much worse than the show portrays in China since they are not exposing anything but what they are told willingly enough.

The second film shows how complex struggles of oil and gas profits, ethnic values and wetlands management affect all of Louisiana and the nation. However, this is done in the context of a close-up portrayal of a few crawfishermen in the Atchafalaya who are not even filmed in an entirely accurate or honest way. The film is in many ways anti-Acadian in it biases and is only forced in the other direction by Katrina. The tendency is to represent swampers as typical Acadians and to represent all swampers as more cut-off from the larger economy than they are. But regardless of where it comes from it says good things with important images.

Then we have the vast problem of angry,ignorant and hate-filled black racist destroying this country in so many ways with the support and formation that has poured in from the west-hating Moslem world for centuries but especially the last fifty years. We ignore all the signs and are headed to destruction but at least our reports give us some of the relevant factoids:

Then we have two movies that show a somewhat unfavorable vision of the military and those who serve in it as well as showing why the enemy would not be so ready to flee at their approach. However, the movies are also full both of whole and partial truths as well as humane insights.  I recommend watching them both with a critical eye  but not disparaging the critical eye they turn towards our country and armed forces.

The truth is that we have so very much to do as soon as possible if we are to be in any way successful as a society. We have many enemies and competitors around the world who will try to keep us from making and then securing the right transitions. However, we are full of internal problems that are far more dangerous. The time to act is here and will not last forever. However, awareness of the pain is the first step towards healing the wounds and pains.

In the models for change I have described here I have set forth a path that can lead to a btter future. But getting there will not be cheap and easy.

The Lower House of the Direct Imperial Government Legislature

Under the model of Government outlined in this blog the United States will continue to have a (reformed)Senate representing the States of the union. It will also have a (reformed) House of Representatives representing the people of the Union which would be the Federal American Empire of the United States. All of the States we all know Louisiana, Hawaii, Georgia, Alabama, California and New York as well as their more than forty sisters will remain States with their own legislatures. However, there would be a number of changes including ceding some lands and rights to a Direct Imperial Government.

I.The Seats in the Lower House (or Chamber) of the Direct Imperial Government

A. Compact Seats

1.There would be two delegates elected from the Lower Chamber of each Compact Legislature of the Thirteen Compacts of Jurisdictions making up the empire.

2.The Empress would also appoint four outstanding female delegates from throughout all of the Lower Chambers of all the Compacts. 

B.  Zone and Fiefdom Seats

 1. The lower chamber of every Compact Zone in a State would send two delegates to the DIG Legislature on years ending in 0,1,2, 6,7, & 8.

2. The lower chamber of every Compact Zone in a Territory or Possession would send two delegates in years ending in 0,1,3,4, & 9. They would send one delegate in years ending in 2 & 5. 

3.  The Advisory Council to the Seigneur in each Fiefdom would elect two delegates each three-year term to this chamber. The highest ranking Mistress certified by the Mistress of Ceremonies to a Peer Elector or(if there is none such) to an Heir to the Peer-Elector who is Seigneur of each Fiefdom who is not an aristocrat will be seated in this chamber perpetually. 

4. All other zones would elect one delegate for a three-year term and the delegate would always be seated.

C. The District of Columbia Seats

The District of Columbia would seat forty delegates according to its own constitution.

D. Crown Colonies and other Colonies

Based on a set of criteria in the DIG Supreme Charter shall seat either one, two, five or seven delegates. There would be no colonies above one seat in the beginning of the DIG. 

E. Imperial Services Seats.

Every Imperial Service shall elect two members from it Employees Association. Every Imperial Service will also have one member appointed as a delegate by the Imperial Civil Service  and one member appointed by the GRIHHA. Military and Civilian services shall be equal in this regard and members of the Nobility of any kind may not serve in these seats.

F. Guilds

Every Guild that conforms to the Supreme Charter and has a Guildhouse on DIG land will be represented in this chamber. 

1. Senior Invited Guilds will have four delegates each. These shall include and mostly consist of the following groups if they form guilds: California Vineyard Guild, Old American Sugar Guild, Louisiana Oyster Guild, Louisiana Crawfish Guild, Texas-Oklahoma Cattle Guild, Seaboard Tobacco Guild,  American Brewers Guild, New England Shipwrights Guild, Chesapeake Shipwrights Guild, Gulf of Mexico Shipwrights Guild, Louisiana and South Carolina Rice Farmers Guild, California Fruit Guild, Great Lakes States Apple Guild, Florida Citrus Guild, Idaho Potato Guild, Wisconsin Dairy Guild, Old Southern Cotton Guild, Silicon Valley Electronics and Information Products Guild, Wall Street Financial Services Guild, The Guild Named for the Johnsons that Joins American Family Manufacturers of Consumer Products , the Kentucky Distillery Guild and the Old Steel Guild.

2. Every other Guild will elect two delegates.

G.  The GRIHHA Appointed Family Seats;

The GRIHHA will appoint a whole set of seats to four-year terms by general vote of their assembly.

1. The GRIHHA will appoint ten grandmothers.

2. The GRIHHA will appoint twenty mothers.

3. The GRIHHA will appoint fifteen Family  Associations who will chose their own delegates.

4. The GRIHHA  will appoint five first wives or high wives of men with harems or licensed mistresses.

H. The Imperial Chaplain’s Seats.

The Imperial Chaplain will appoint ten Catholic, three Orthodox and three other member of religious and clerical classes of low rank to the chamber.  

Obviously, the lower Chamber will be large and therefore somewhat unwieldy.  However, it is meant to be large and there is nothing unnecessary about its size.  The Supreme Charter and the Constitution would only assign limited powers to this Legislature. However, the work it would do would be essential and vital to the whole regime.

A Return to the Modeling of a Royalist Federal Imperial American Model

I am not printing out the majority of these posts anywhere and having some of them on flash drive does not and never would answer all questions related to organization of material. There are bound to be some contradictions and problems of continuity.  These would be problems I would take more seriously if this were an established government issuing official documents. However, writing as the ultimate outsider I am not troubled by this. There are so many things to work out before any of this can be worked out in fact there are a million things to do besides achieving perfect editorial cohesion.  I am returining to this model and am writing about a little bit of in outlining one more component. The model is based on a royalist concept that balances monarchic, aristocratic and democratic elements in an effective mixed and federal system. This is the group of Aristocrats just below the Peer-Electors at the top of the proposed Upper Nobility.

In previous blog posts I have discussed Forty Peer-Electors who would play a vital role in the establishment of the Empire and Emperor in the transformed United States. I have also posted a requirement for a High Council of Nobles in the Direct Imperial Government.  The large majority of the Forty Peer-Electors proposed would be hereditary familial peers.  There would also be a Group of ten members of the Upper Nobility of the proposed Empire who would fill extinct places in the fixed allotment of Peer-Electors. These would be the Ten:

1. The Count Rockefeller of New Jersey’ s New Holland

2. The Count Ford of Detroit

3. The Count Walton of Little Rock

4. The Count Dupont of  Kentucky and Delaware Removes

5. Count___________ and of Hendrickson of the Lakes,  Chief of the Scandinavians of Wisconsin and Minnesota

Why I Dare to Advocate Radical Change…

As I start to get back into the swing of this blog and some of its long-term themes I am forced to consider and address those who might ask why I should dare to advocate radical social change.

Well, because young people in the United States seem confused about some of the meaning and consequences of their sexual-social choices.

Because married filiation is under stress as is the American family structure and there is a real race to the bottom because only marriage is a recognized domestic regime. Society is destroying basic human community.

Because, after huge amounts of social change at gunpoint the black community in America is really in a downward spiral in many ways. The great project of this country in my generation is suicide.

Because, we have destroyed communities in favor of society and society is doing an increasingly poor job of holding things together. Corporations and governments are not able to care for all this dislocated people well.

Because our absurd idea of national morality focuses largely on the total prohibition of recreational drugs and prostitution and it is quite possible to argue that this is not only hypocritical but also misguided.

So this is why my royalist American program for radical change is something I continue for as long as I can stay here. I do think that things are disastrous in many areas of society besides coastal policy. I favor radical change because I think we are radically off-track.

Why the Oil Leak in the Gulf has Dominated this Blog

I am not running a specialty blog here. I have a personal and fairly general purpose blog.  Yet there have been so many posts on the BP Oil Leak and none that were not at all related to the oil disaster in the Gulf in quite a while.  I want to use this post to discuss briefly why I have given so much more attention to this situation than I have to anything else since I began this blog. In case anyone reading has any doubt, I had not started this blog when the September 11, 2001 attacks occurred.  If I had this blog in those days I think that I would have posted about it for a similar length of time with relatively comparable intensity. I did in fact bring it up fairly often and fairly early in the newspaper articles that I published when writing as a reporter and as a feature writer in those days.

I did  and do think that World Trade Center and Pentagon wrecking crisis was a life changing kind of crisis.  I also think that this wetlands crisis is a life changing kind of crisis.  I think that this crisis makes us aware of the vitality, importance and threatened state of Louisiana and Gulf Coast wetlands. I think that this crisis can make us aware of certain strengths and weaknesses of our global , national and regional economies that are not well enough known nor carefully enough considered. We need to also understand how little planning, responsibility and mitigation exists in huge areas of our economic life. We need to understand how often we punish those behaving responsibly and excuse those pillaging the planet. I have pointed out repeatedly that BP is a British corporation. In balance I would like to encourage you to hear this address from Prince Charles of Wales, Duke of Cornwall  to the Copenhagen Conference on Climate Change before all of this began. I think his words show that there are many tie to be formed and bridges to be built to secure a decent future. I have given this disaster so much emphasis because it is an incident about which I have a great deal of background knowledge. I am positioned to understand a great deal about all of this and explain some of it my blog’s readership. I have fished and boated these waters. I have done research and paralegal tasks for lawyers involved in spill and oil industry law suits. My life has involved a great deal of study about the peoples and history of Louisiana and the Gulf Coast. These frames of reference and sets of facts have given me an understanding of how this tragedy has been playing out across this region.

Now I am not going to blog about this oil mess forever. If I do not die first of something beyond my control I expect to write on other subjects again soon enough. In fact it will be a relief to reassert the independence of this blog from any one subject.

The BP Oil Spill & Tyranny: Links and Notes

I. “If This Be Treason Make the Most of It!”

I will not interpret or attribute the quote above nor even say what it has to do with the horrors and struggle  in the Gulf of Mexico. For me the gusher crisis is the very strong indication that we should have real and radical change. I do not think we are likely to undertake the right changes. However, prior to the spill I had been outlining some ideas for radical change. I believe that the word Tyranny which was once the greek word for a bad monarchhas been changed by usage. The Greeks had a word for a bad aristocracy which we translate as oligarchy now and a word for a bad democracy which was ochlocracy. They could discuss intelligently what a mixed government that combined the rule of the many, few and one would be like when it was rotten. Even though most of there best political sages believed the best government would combine rule of the one, the few and the many.  Other thinkers like Montesquieu also saw that mix as ideal and it is the template of our governance. But I do believe our government has become corrupt as an institution in a way which makes it an institutional tyranny. It is from this base of ideas that I have written many blogs posts about radical political change. These posts propose change. However, while I am not hiding these posts there are too many of these blog posts to link them all to this site. So while none of these people or institutions are advocating radical change as I am they can all see that this is a very serious situation.  We are also in a country which was already in some trouble and had some difficulties which were well-defined before this gusher blew through its controls. Besides those who are making lots of money in business under the current mode of the country’s operations there are also those who are highly motivated to be recognized as being accurate. This University of Louisiana has a lot of resources to bring to this discussion that are likely to emerge as the crisis unfolds. They are likely to bring more of those resources to bear as one needs to analyse things in detail. They have expertise in petroleum and wetlands related subjects for example. However, they also have expertise in understanding how the whole complex of cultural and market forces which make up the state’s tourism scene. See this link for that  coverage:

However, I want to make it very clear that I am referring to none of these people and groups in the Academic because I believe that they advocate cultural change.  All of the people listed above are simply evidence that there are major issues involved in this major event.

The longer the crisis goes on the more there will be discussion of what it all means. The news is still spreading. The ferment of political discontent may grow over time. BP has no certainty about when it can get control of this situation. We are in the throes of a full-blown calamity. The world can see the struggle as well, which I indicated in my last post. V. American Change Agents

There is a crisis. That much we know and the question becomes is our system creating or worsening the crisis in many ways. I think that it is. I want to explore our political situation within this context.  Now I am leaving behind a review only of the discussion of the BP Gulf of Mexico Spill. I want to discuss those who are looking for change. They do not all seek the same kinds of change and some do not believe they favor any kind of radical change. Yet, the truth is that all of them are seeking change and proposing policy or lifestyles that if they were more successful would remake America. I am listing only groups that I believe are both legitimately American and legitimately responsible groups. 

I think that we can argue that this is a time that demands radical change. I do argue that it is time for radical change. While the regime change that I have proposed earlier in this blog’s posts are my ideas and I do not claim that other American change agents support them I do think it is significant that there are many “American Change Agents” who are not informed by selfishness or hate primarily but pursue differing responsible ideals. So I want to discuss what the options are and why we should consider those options. Of course I would like to see them informing and enriching the vision I have proposed. Together we might reach more successful solutions.

The British Petroleum Oil Spill and Memorial Day

Memorial Day actually springs from the traditions which came out of the Civil War, War Between the States, War of Northern Aggression, War to Save the Union, War for Southern Independence, Last Stand of Western Civilization or War to Put Down Rebellion– that great cataclysm of bloodshed and destruction which to many Southerners is what one is always presumed to be speaking about when one simply says “The War”. However on this Memorial Day my memory turns to the War Americans call the War of 1812 which gave us our National Anthem and the first complete military victory of the US over the Brits in a major engagement where no foreigners helped. That came in the battle of New Orleans.  Despite Lamar Mackay, Bob Dudley and thousands of US employees and stockholders the odd truth of all this is that the British and their Swiss allies are invading our most precious resources under the leadership of Tony Hayward and under the concealed banner of British Petroleum.

Below we have a map of how the British invaded Baltimore and how Americans sunk their own ships in a line to block access to the harbor. The British were large held at bay by that single maneuver and the heavy artillery from a fortress which was operating under an enormous star-spangled banner which a lawyer saw from a truce ship and about which he wrote the song which became our anthem.

The American gunboats were supported by a line of sunken American ships in lines not shown on that map that were sacrificed by the waterfolk and traders to limit movement of the mighty British fleet as well as by the fort McHenry which fired off huge guns and small ones beneath an enormous starry flag. The battle was watched by a lawyer in a truce fleet and  he wrote our National Anthem from its inspiration.

The round of hostilities between Britain and America which reached such poetic height in Baltimore reached it end in the Battle of New Orleans which was fought very near where the current battle for the survival of the marshes is ongoing. We are facing the invasion of British Petroleum Crude near where Jackson and his army and Lafitte and his navy (injured by a new American attack) drove off some fine units of UK invaders. There in New Orleans they handed the British the first decisive defeat at the hands of an all American force in a major encounter. The Revolution owed much (if not most) of its winning to the Kingdom and Empire of the French but here French and English-speaking Americans drove out the British Empire in blood-soaked victory alone.    

This 2010 battle of Memorial Day  is an epic struggle and the stakes are very great. It is hard for us to win on this side because if there is little damage it will be used as an excuse for future sabotage or carelessness to be more easily permitted. If there is great damage then we live in age when the natural world is already under great strain and we have rich “well-educated” idiots (who had the capacity not to be idiots when they were young) in government and in big business who never think things through as regards the natural world. I hear so many stupid and irrelevant remarks. The damage done in a short period of time can wipe out millions of years of vital continuity and removing the toxins through there being biodegraded later won’t help. The oyster beds of South Louisiana ought to be compared and classed with vineyards of Napa and Sonoma and instead are classed with the sands of the Arabian deserts. It is hard for me to write this through all the pain and depression I am feeling.
I am very careful to use legal materials in this blog but if I have infringed any rights in this post I will worry about it after I see how much of my homeland has survived. This is a struggle  of enormous proportions. The eleven killed in the explosion and the  dozen or so cleaners who have been hospitalized have suffered in a war in which admirals, generals and Guardsmen are also battling. This is really a struggle for what cannot be replaced.

Like Baltimore and Lafitte’s flotilla it has fallen to small ship and boat owners to bear the brunt of much of this great battle and they do so alongside the Coast Guard and others in their government’s formal service. But is their civilian service much less patriotic?

This flotilla of shrimp boats sails like the Americans of 1812 and 1814 to save their homes families and country. Already some languish in hospitals. Are they not our heroes too?

Louisiana National Guard fights a new enemy.

The National Guardsmen know that their world will not recognize this as combat. They will earn no new respect on world battlefields. Yet they risk their health in a beautiful but dangerous coastal wilderness under hot suns in proximity to possible and unmeasured risks of poisoning. The battle for their homeland and can not hurt the liquid at which they throw their human and mortal flesh. Are they not good warriors in this case as well?  

Oh! thus be it ever, when freemen shall stand
Between their loved home and the war’s desolation!
Blest with victory and peace, may the heav’n rescued land
Praise the Power that hath made and preserved us a nation.
Then conquer we must, when our cause it is just,

 I wish everyone a good Memorial Day weekend. I have several friends nobly risking their lives in the two foreign wars we are fighting  and I wish them well.  SD, AD, JS,and JS if you read this know you are not forgotten. But this day my heart is full of pain and also the debt of respect for those who fight with little hope for honor or glory against an invasion so near to so much that I love. 

Note: Throughout the BP Macondo oil leak crisis I was responding day by day to an enormous set of devastating problems for many that I care about deeply or am connected to. While I have made no money on all that work and tried to use my own, open source or public domain materials in every case the stresses were enormous. Biggest US Spill: Living in the Age of Liquidation

This BP — Transocean spill  is not just another mess. This spill is historic and calls for a response in historic terms. It also must be seen in context. That context and response is what this post is about.  The liquid nature of the spill goes with the crisis of unstructured flow of migrants who are joined by the desire to make money flow around for no real reason. This joins with the government forcing racial groups to flow together in no structured way. This goes with an economy designed to liquidate all wealth and punish the kinds of wealth that does not flow quickly. In may ways this spill symbolizes our whole set of social disorders. 

We are facing the largest oil spill in US history. We had the failed Times Square bombing, the underwear bomber, the Fort Hood shooting and we have hundreds of thousands of people protesting  forcefully to proclaim that one should be able to stay here as long as one wants without documentation. Not all the Arizona law protesters want to say that but hundreds of thousands do. We have people in our congress advocating an unconstitutional ex post facto law against BP. Here again the nuance is that if Congress were saying they would issue letters of Marque and Reprisal against BP if they do not adequately deal with the spill I would not object (Britain would but not I). Our debt to revenue ratio is outrageously high and people largely believe we should all spend more to stimulate the economy.  We are still involved in two foreign wars. In my opinions all the things I mentioned above are only minor symptoms of the disease afflicting our society. We are a country in crisis, deep and serious crisis.

I am different from  most of those who are likely to read this blog as American citizens in that I support and advocate radical constitutional change. I advocate change which is revolutionary  — although I am willing to see that change come in the following Constitutional form: “or, on the Application of the Legislatures of two-thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as part of this Constitution, when ratified by the Legislatures of three-fourths of the several States, or by Conventions in three-fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.” This quote makes up most of Article V (Article Five) of the Constitution.

The part I did not include is the first few words reproduced here and now ” The Congress, whenever two-thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, (or, on the Application of the Legislatures)” the words in parentheses are the words at the start of my quote above. All amendments in US history have been passed through the houses of congress and then ratified by the States. However, a constitutional convention summoned by  two-thirds of the States  and ratified by three-fourths of the States could effect total transformation of the country as long as every State retains equal votes in the Senate and the entirely new Constitution would be a formal and legal continuity of our current regime. The only role of Congress in this second path would be to choose whether State legislatures or State conventions should ratify the larger convention.  In the real world if a convention had been called then force of arms would be justified if (by no means certain) a Congress refused to act to make this one choice. Thus if three-fourths of the states can be convinced of the need for radical change then we can have it. And we do need radical change. It is time for our society to evolve. I have outlined the ideas for a new regime elsewhere in this blog.

We need to create a system which will value conservation, preservation, familial wealth, nature, honor and recognize that neither big business nor bureaucracy has all the answers and yet both have a role to play. The risks these spills and other things like the war on terror relate to or not adequately addressed in an eight year presidential administration. We need the kinds of changes we are very far from adopting so far.  The total destruction of our society is what is likely if we continue to follow the path we have been following .  As our society becomes more dysfunctional the rate of decay will increase. Making the right changes now will be very hard but making them later will be much harder.

We are partly destroying and may be largely destroying an estuary which is the product of processes ranging in millions, thousands and hundreds of years. We are doing this in days and months. We need a government with a loner term view of things. However, not just any old thing will do. We need to make  the right changes. I have tried to outline those changes elsewhere in this blog. But we will not have many more chances for good change. It will not be long before any effort we make will be the kind of desperate and frenzied reaction that seldom works out well — to say the least.  This may be our last chance to create change that is rational, wise and measured. 

So let us consider really  changing the government. We have a choice now. That will not be true forever.

The Direct Imperial Government in the New American Regime: Part Three

This is my third post on the Direct Imperial Government in my proposed new regime. In this post I wish to cover two agencies of the proposed DIG. I have done a lot of posts in this blog on healthcare under our current political order.  Here are two of them:

The others that I have done should be searchable. However, the second of the two links I have provided above would more or less indicate the operations of the Imperial Wellness Agency which would do approximately what the proposed National Wellness Agency would have done. It would of course be stronger and more effective than the NWA because it would have a fixed base of two percent of all DIG funds to add to its revenue streams. It would be a large constitutional anomaly as will all of the major DIG agencies and ministries but it will operate in a well-defined and circumscribed sphere of action. It will consist of a web of specific exceptions to the normal way of doing business. The taxes it receives that I really drew up for the NWA should stand even though they are less appropriate for the DIG than for the federal program I proposed.  This intrusion will be modest if this regime actually emerges. One must remember that this would be a revolution that leaves the vast preponderance of resources in a slightly altered set of institutions that have evolved within a republican structure.  This is a very American approach since America’s 200 and more republican years have merged from a relatively slightly modified version of British and Arcadian-Acadian royalist regimes mixed with Iroquois Chieftainly confederated mixed government  seen through the lense of Greek Classical political science and the Roman republics emergence from the Kingdom of the City of Rome. In the tradition we now would move like Rome from Republic to Empire. However, the American enterprise has never been a purist enterprise and this is not a purist’s proposal.

I will not discuss the details of the Imperial Wellness Agency here except to say that it would support a web of Community Clinics, employ most law and medical school students for a few days in their career, offer token pay to volunteers and track them, recycle surplus pharmaceuticals, rely in part on taxes on migration and dangerous activities from abroad. It would offer sponsorship networks and support emergency response to common disasters. There would be a kind of token insurance program and it would provide some level of available care (much inferior to the very best available) to everyone for little or  even no cost  in a way which demands from but does not destroy private market care. It will also create incentives to control cost which no current system employs well.

The last agency I will discuss in this little series is the Government Liaison to the Imperial House and Household. This agency will seek to ensure that all DIG programs and actions tend to support and enhance and not oppose or curtail the Imperial House and Household’s civilian and military agencies. There will be a Women’s and Family Division which will make sure that the Imperial Wellness Agency and Rolls of Kindreds as well as ordinary organs of governance support the Empress’s Bureau of Women’s Affairs and the Mistress of Ceremonies’ Office of Liaison’s and Placements. It will have an Enforcement Division which will support the integration of the MC’s Office of Ritual Confrontation, the House’s military, the Ministry of Protocol and GRIHHA regulations and proclamations into the law and law enforcement. It will have a Habitat Division to support integration into IWA (Imperial Waste Authority), the HHEA (Human Habitat Expansion Agency)and the local governments all related Imperial House work. Lastly the GLIHH will have the Personal Ministry Division which will assign people to see to the needs of House members discharging DIG functions or interaction in any official way with the DIG

These four agencies are not everything that there is within the DIG. However, they do set out a picture of all that the Direct Imperial Government would and would not be within the new regime. That should make it easier to see what the costs of establishing the new regime would and would not be.
